Court Rebuffs Samsung's Bid to Halt Microsoft Lawsuit


A U.S. federal court has rejected Samsung's application to halt a lawsuit filed by Microsoft over patent royalties.

Microsoft filed a suit against Samsung in August seeking to verify whether the Korean company infringed Microsoft patents used in the Android OS.

Samsung says Microsoft violated contractual terms in its acquisition of Nokia that included the patents.

Samsung last month turned to the International Court of Arbitration for help and asked the U.S. court to delay the patent lawsuit in the meantime. In September, Microsoft CEO Satya Nadella visited Samsung headquarters in Seoul for negotiations with vice chairman Lee Jae-yong, but the lawsuit continues.

Julianna Margulies lawsuit with ex-manager to go forward in October

LOS ANGELES (TheWrap.com) - "The Good Wife" star Julianna Margulies was allegedly a bad client, and now the actress will have to face trial over it.

Margulies suffered a legal setback in court on Tuesday, when a judge denied her motion for summary judgment in a lawsuit brought against her by her former management company over commissions it says it's owed.

D/F Management claims it's owed money stemming from Margulies' work on "The Good Wife" and for her work with cosmetics company L'Oreal.

Margulies, who has filed a cross-complaint against D/F Management for breach of contract, denies the claims, arguing that the company had no written agreement. While the actress' legal representation will move forward with that and other defenses, the argument wasn't enough to spur a summary judgment of the suit.

A trial date on the matter has been set for October 9.

"We are pleased but not surprised by the judge's well reasoned decision rejecting Miss Margulies' motion," Matthew Rosengart, an attorney for D/F, said. "My clients are disappointed that she reneged on her agreement and then filed a meritless motion. We look forward to the trial in October."

According to court documents obtained by TheWrap, Margulies retained D/F in 2009 and terminated the relationship in April 2011. But D/F contends that it's owed a 10 percent commission on Margulies' earnings for "The Good Wife" and L'Oreal after the dissolution of the relationship, an assertion that the actress disputes.

Margulies' motion for summary judgment, filed in February, argued that, since she is a New York resident and D/F's business is based in New York, that the state's statute of frauds should be applied, which Margulies' team contended should lead to a summary judgment. However, the judge said that there was a factual dispute that prevented him from ruling on the motion as a matter of law at the moment.

Lawsuit Coming?


LOS ANGELES ? The woman who was kicked by Miguel during a Billboard Music Awards performance continues to suffer cognitive difficulties and has yet to receive any assistance from the R&B singer nearly a month after the incident, her attorney said.

Doctors continue to evaluate Khyati Shah's injuries, but the exchange student from New Zealand has memory loss issues and has been unable to sit for final exams, attorney Vip Bhola said in an interview Thursday.

He said despite efforts to find out more about rehearsals for Miguel's performance and seek help for his client, representatives for the singer and the awards show are practically daring him to sue.

Miguel's representatives have said Miguel is concerned for Shah's well-being and reached out to Bhola to see if they could help.

Bhola said while he's talked with Miguel's attorney, no assistance for his client's medical bills or other expenses have been offered.

The lawyer said Shah, 21, went to the Billboard Music Awards in Las Vegas and was excited at the prospect of seeing Miguel. The singer-songwriter leaped from one stage to another while singing his hit "Adorn," catching his leg on the back of Shah's head and slamming it into the platform.

Shah later appeared alongside Miguel in a televised interview holding an ice bag on her elbow, a move that Bhola said was offensive.

"They didn't rush her to the hospital," Bhola said. "Instead they rushed a camera to her and an ice pack" and took advantage of a "star-struck, dazed and injured person."

Producers of the Billboard Music Awards declined comment.

"Khyati's wellbeing has been and continues to be of the utmost concern to Miguel," the singer's spokeswoman wrote in a statement released earlier this month.

"She was a fan of Miguel and she's dumbfounded at how she's been treated," Bhola said.

"She had hoped they would truly care about her rather than merely caring about themselves and some imaginary lawsuit they are defending against," he said.

Shah is studying for dual-degrees in politics and philosophy at UCLA. Bhola said she had planned to return to New Zealand for the summer, but her travel will likely be delayed while she continues to undergo treatment and testing for her memory and language issues. He said she has trouble finding words and also has difficulty typing text messages without them turning out garbled.

Despite the issues, Bhola said a lawsuit is not guaranteed.

"The doctors really are in the driver's seat in this situation, not the lawyers," he said. "Once we have that information, we'll be able to make legal evaluations."
